Terms of Use

1. Acceptance of Terms

By accessing or using the Presency platform ("the Platform"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Use License

Presency grants you a non-exclusive, non-transferable, revocable license to use the platform to manage business operations and publish supported selling channels. You may not:

• Modify or copy the core platform code.
• Use the platform for any illegal purpose or to sell prohibited items.
• Attempt to decompile or reverse engineer any software contained on the platform.
• Remove any copyright or other proprietary notations from the materials.

3. Account & Subscriptions

Some Presency tools and plans are subject to recurring subscription fees. Failure to pay for an active paid plan may result in the restriction or suspension of paid features. Presency reserves the right to terminate accounts that violate our community standards or engage in fraudulent activity.

4. Content Ownership & Acceptable Use

You retain all rights to the content you upload to your storefronts (logos, copy, product data). By using the platform, you grant Presency a limited license to host and display this content on your behalf.

You agree not to post, upload, or distribute any content that is illegal, objectionable, abusive, harassing, hateful, fraudulent, deceptive, pornographic, or that infringes another party's rights. This includes spam, scam listings, counterfeit goods, and impersonation. Presency may remove content and suspend or terminate accounts that violate these rules. Users of the Presency Stores app may report and block other users or stores; reports are reviewed by our team.

5. Marketplace & Independent Vendors

Presency is a business platform that may host storefronts and optional marketplace listings. Product listings, prices, descriptions, images, and availability are created and maintained by independent vendors (“Store Owners”). Presency does not verify the accuracy of all listings and does not guarantee that any product description, price, or image is complete, current, or error-free.

Store Owners are solely responsible for their listings, inventory, pricing, fulfillment, delivery, returns, refunds, and customer communications. Presency is not the seller of record for products listed on individual storefronts unless explicitly stated otherwise.

6. Purchases on Storefronts (Buyers)

When you purchase from a storefront powered by Presency, you are buying from the Store Owner operating that site, not from Presency directly. You agree to review product details, pricing, shipping or pickup terms, and store policies carefully before completing a purchase.

Disputes about product quality, delivery, cancellations, or refunds should ordinarily be raised with the Store Owner first. Where an order is expressly marked as covered by Buyer Protection, the buyer may also report an issue through the order screen or Presency support before the displayed release deadline. Presency may request information from both parties, pause the vendor payout while the issue is reviewed, and facilitate an appropriate resolution, including release, continued hold, cancellation, return, replacement, or refund where applicable.

Buyer Protection does not replace or restrict any return, refund, warranty, or other consumer right provided by applicable law. Reporting an issue does not automatically guarantee a refund, and buyers and Store Owners must provide accurate information and cooperate reasonably with the review process.

7. Payments, Buyer Protection & Payouts

Checkout payments on storefronts are processed through third-party payment providers (including Paystack). By paying, you authorize the payment provider to charge your selected payment method for the order total shown at checkout.

Presency facilitates payment collection and may route transaction proceeds to Store Owners according to platform rules, applicable fees, and the settlement services supplied by our regulated payment partners. Only orders expressly labelled with Buyer Protection before payment use the delayed-settlement feature, including eligible financed orders. Buyer Protection is not a bank account, savings product, or representation that Presency is a licensed escrow institution.

For an ordinary paid order, net proceeds become available in a verified Store Owner's Presency Wallet when payment is successfully confirmed. If the Store Owner is not verified, the proceeds remain pending until the buyer confirms receipt, a supported courier confirms delivery, or 72 hours after the Store Owner marks the order fulfilled, or sooner if verification is completed.

For a protected order, the Store Owner authorizes the net payout to remain pending until the buyer confirms receipt, the displayed automatic-release period expires, Presency resolves a reported issue, or another release or refund event described on the order occurs. The buyer must not confirm receipt before receiving and reasonably checking the order. If no issue is reported before the displayed deadline, the payout may be released automatically. Automatic release does not remove rights that cannot lawfully be waived.

Store Owners authorize Presency and its payment partners to delay, reverse, deduct, or set off amounts reasonably connected with refunds, reversals, chargebacks, disputes, duplicate payments, fraud, applicable fees, or negative balances. Released balances remain subject to payment-provider processing times, transfer availability, compliance review, and correctly configured payout details.

Completion of a Buyer Protection window establishes that an undisputed payout may be released, but does not override identity verification. Released funds become available in the Store Owner's Presency Wallet. A payout bank is required to withdraw, and identity verification is required once total withdrawals pass a limit set by Presency. Presency does not confiscate or automatically return an undisputed released amount merely because verification is pending.

Presency is not responsible for delays, failures, or reversals caused by payment providers, banks, or incorrect payout details supplied by Store Owners.

8. Disclaimer

The materials on Presency's platform are provided on an 'as is' basis. Presency makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

Nothing in these Terms excludes or limits a right or remedy that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence, or breach of applicable consumer-protection law.
